Minor property dispute

We have been in our house for over 25 years.

Our driveway encroaches on to our neighbors land. A narrow strip starting at about 1 1/2 to 2 foot at the top and running 10 yards.

When we moved in we had a document drawn up for a consideration of $10 that would allow the encroachment.

Now that we are considering moving, our neighbor came to us and wants to formalize it by replating both lots and selling us the narrow strip of land.

The alternative is to pull up the asphalt and lay the driveway on our property. Maybe $20K.



Any ideas how to handle this? How do we get the survey done if we go that route. How much time? Relator things 3-4 months which would take us past our prime selling season.

If we rip up the driveway, is there any repercussions? It is on his property.

I'm willing to pay for real estate lawyer if it comes down to that.
