Question for atty or those that might know. Our company changed stock grant plan this year. Summary - stock grants vest at end of three years. If you leave before three years is up, employee forfeits stock grants. However, as part of grant, employee agrees to one year non-compete on customers and non-solicit of employees.
Question is this - if an employee were to leave before three years is up, and thus had to forfeit stock grants, would the non-compete still be enforceable?
